Treatment of misclassified private hire drivers and couriers in the Low Pay Commission's national minimum wage reports and recommendations

The employment status of a considerable number of private hire drivers and couriers may have been unlawfully misclassified by private hire operators and courier organisations. We are concerned about the potential treatment of a portion of private hire drivers and couriers in the of the reporting and recommendations by the Low Pay Commission on the national minimum wage.

Updates

1. Freedom of Information request

On 24 October 2020 we sent a Freedom of Information request to the Low Pay Commission.

2. No response to our Freedom of Information request

On 24 December 2020 we wrote to the Low Pay Commission explaining that we were yet to receive a response to our Freedom of Information request dated 24 October 2020, and we reissued a copy of the request.

3. Complaint to the Information Commissioner's Office

On 12 March 2021 we filed a complaint with the Information Commissioner's Office asserting that we had received no response to our Freedom of Information request to the Low Pay Commission dated 24 October 2020 and reissued on 24 December 2020.

4. Freedom of Information request response

On 28 April 2021 we received a Freedom of Information response from the Low Pay Commission apologising for its late response and explaining that it did not receive the Freedom of Information requests. Low Pay Conmmission stated that was not in possession of the requested information and explained its reasons why this was the case.

This investigation is currently paused and under review.
