Treatment of misclassified private hire drivers

The employment status of a considerable number of private hire drivers may have been unlawfully misclassified by private hire operators. We have concerns about Transport for London' potential inadequate prevention of and enforcement against private hire operators such unlawful practices. Drivers may be deprived of payment of at least the national minimum wage and holiday pay due to the continuance of potentially unlawful practices by some private hire operators.

1. Freedom of Information request

On 02 November 2020 we sent a Freedom of Information request to Transport for London.

2. Freedom of Information request response

On 03 December 2020 Transport for London responded to our Freedom of Information request dated 02 November 2020, confirming that the cost of its response would exceed the statutory "appropriate limit". Transport for London explained that our nationality breakdown request posed its main difficulty, and it would hopefully be able to process our request if the nationality breakdown request is removed.

3. Reissued Freedom of Information request

On 30 July 2021 we sent a revised Freedom of Information request to Transport for London. A response is due from Transport for London by 27 August 2021.
